Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Bloggerly website and application (together, the "Service"), operated by Bloggerly Limited (company number 17364155), a company registered in England and Wales with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. In these Terms, "we", "us" and "our" refer to Bloggerly Limited, and "you" refers to the user of the Service. These Terms apply to both bloggerly.ai (our marketing site, hosted on Framer) and the Bloggerly product application at app.bloggerly.ai.
1. Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service. If you are entering into these Terms on behalf of a company or other organisation, you confirm that you have authority to bind that entity.
2. Eligibility
You must be at least 18 years old to create an account or use the Service. By using the Service you confirm that you are 18 or over.
3. Accounts
When you create an account you must provide information that is accurate, complete, and current. Failure to do so is a breach of these Terms and may result in suspension or termination of your account. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
4. Subscriptions, Billing and Cancellation
The Service is offered on both a free tier and paid subscription tiers ("Subscriptions"). Paid Subscriptions are billed in advance on a recurring basis ("Billing Cycle"), monthly or annually depending on the plan you select.
Auto-renewal. Paid Subscriptions automatically renew at the end of each Billing Cycle at the then-current price until cancelled. The renewing nature of the Subscription and the applicable price are disclosed to you at the point of purchase.
Cancellation. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current Billing Cycle; you retain access until then and are not charged for the following cycle.
Refunds. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial Billing Cycles or unused features.
Consumer cancellation right. If you are a consumer, you normally have a 14-day right to cancel a purchase of digital services under the Consumer Contracts Regulations 2013. By starting to use the Service during that period you expressly request immediate performance and acknowledge that you lose your right to cancel once the service has been fully performed. This does not affect your other statutory rights.
Price changes. We may change Subscription prices. We will give you reasonable advance notice of any price change, which will take effect from your next Billing Cycle. If you do not agree, you may cancel before the change takes effect.
5. Ownership of Generated Content
The Service uses artificial intelligence to generate content ("Output") based on the inputs, prompts and materials you provide ("Input").
You own the Output. As between you and us, you own the Output generated for you through the Service, on both the free and paid tiers, and you may use it for any lawful purpose. To the extent we hold any rights in the Output, we assign them to you.
- No warranty on Output. AI-generated Output may be inaccurate, incomplete, outdated, or similar to content generated for other users. It is provided for your review and is not guaranteed to be accurate, original, or fit for any particular purpose.
- Your responsibility. You are responsible for reviewing, fact-checking and editing Output before you rely on or publish it, and for ensuring that your use of the Output is lawful and does not infringe the rights of any third party.
- Non-exclusive. Because the Service is used by many users, similar or identical Output may be generated for others. We do not guarantee that Output is unique to you.
6. Your Content and Licence to Us
The Service allows you to submit, post, store and share information, text, graphics and other material ("Content"). You retain all rights you hold in your Content. You are responsible for your Content, including its legality, reliability and appropriateness, and you confirm that you own or have the necessary rights and permissions to submit it.
Licence. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process and transmit your Content solely to the extent necessary to operate, maintain and provide the Service to you - including passing your Content to trusted third-party AI providers and infrastructure providers so that we can generate your Output and deliver the Service. This licence ends when your Content is deleted from the Service, except for copies retained in routine backups or as required by law.
7. Acceptable Use
You agree not to use the Service to create, upload, generate, publish or distribute any content or to engage in any conduct that:
- is unlawful, fraudulent, defamatory, obscene, harassing, or otherwise objectionable;
- infringes any intellectual property, privacy, or other rights of any third party;
- is spam, or involves deceptive, misleading or manipulative practices, including impersonation or disinformation;
- contains malware or is designed to interfere with, disrupt, or gain unauthorised access to any system, network or data;
- attempts to reverse-engineer, decompile, scrape, resell, or create a competing service from the Service; or
- violates any applicable law or regulation, or the rights of any person.
We may investigate suspected breaches and may suspend or terminate access for conduct we reasonably believe violates this section.
8. Intellectual Property
The Service and its original content (excluding Content and Output belonging to users), features and functionality are and will remain the exclusive property of Bloggerly Limited and its licensors, and are protected by the laws of England and Wales and other countries. Our trademarks and trade dress may not be used without our prior written consent.
9. Links to Other Websites
The Service may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, privacy policies, or practices of any third-party websites or services, and you access them at your own risk.
10. Termination and Your Data
You may terminate at any time by cancelling your Subscription (if any) and discontinuing use of the Service. We may suspend or terminate your account on reasonable notice, or immediately where you have materially breached these Terms, used the Service unlawfully, or where we are required to do so by law.
Data export. Except in the case of a for-cause termination, following termination or cancellation we retain your Content for 30 days so you can request an export. To export your Content, email support@bloggerly.ai and we will provide a copy manually. After that 30-day period, your Content may be deleted in accordance with our Privacy Policy. Provisions which by their nature should survive termination (including ownership, licences granted, disclaimers, limitation of liability and indemnity) will survive.
11. Indemnity
You agree to indemnify and hold harmless Bloggerly Limited and its directors, employees and agents from and against any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of or connected with your Content, your Output, your use of the Service, or your breach of these Terms or of any law or third-party rights.
12. Disclaimer
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, whether express or implied, including implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Output will be accurate or reliable.
13. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. If you are a consumer, nothing in these Terms affects your statutory rights.
Subject to the paragraph above, and to the maximum extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, use or goodwill; and (b) our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (i) the total fees you paid to us in the 12 months before the event giving rise to the claim, or (ii) £100.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that if you are a consumer you may also be entitled to bring proceedings in the courts of the part of the UK in which you live.
15. Changes to These Terms
We may modify these Terms from time to time. If a change is material, we will give at least 30 days' notice before it takes effect, by email or through the Service. Your continued use of the Service after the change takes effect constitutes acceptance of the revised Terms.
16. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the Service. You may not assign or transfer these Terms without our consent; we may assign them to an affiliate or successor. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
